- Definitions
– “We”, “our”, “us” refer to RC Sailing Lab owned by Juan Marcos Egea, with NIF ES47286352P
– “You,” “your,” “customer” refer to the buyer placing an order with us.
– “Product(s)” refer to any item or merchandise offered for sale by us.
– “Order” refers to any purchase request made by the customer and accepted by us.
- Order and Acceptance
– All orders are subject to availability and our acceptance.
– We reserve the right to reject any order at any time without providing explanations.
– Order confirmation will be sent via email once the order is accepted.
- Prices and Payments
– All prices are in EUROS (€) and do not include applicable, duties, or other shipping-related charges.
– We reserve the right to change prices at any time without prior notice.
– Payments must be made in EUROS (€) using the accepted payment methods as indicated on our website.
- Shipping and Delivery
– All shipments will be made under CPT (Carriage Paid To) terms according to Incoterms [2024] unless otherwise agreed upon in writing. In the checkout process you can select to insure the shipment against damage and loss by converting the shipping method to Carriage and Insurance Paid To (CIP).
For CPT (Carriage Paid To) shipping, the seller takes on the responsibility of coordinating the entire shipment, from packing and transportation to the destination, ensuring it reaches the buyer’s specified location. However, it’s important to note that import customs clearance, duties, and taxes remain the buyer’s responsibility in this arrangement.
– The customer is responsible for all shipping costs, import taxes, duties, and any other charges related to the delivery of the products.
– We endeavor to meet indicated delivery timelines, but we do not guarantee delivery within a specific timeframe and are not liable for delays caused by third parties or circumstances beyond our control.
- Returns and Refunds
– RIGHT OF WITHDRAWAL: EXCEPTIONS
The right of withdrawal cannot be exercised for:
- Purchase of downloadable files or programs.
- Purchase of customized or personalized goods, created specifically for the user.
- Provision of services once the service has been fully executed, when there has been express consent by the consumer.
– We accept returns within 14 days of receiving the products, provided the products are in their original condition and have not been used or damaged.
– To request a return, please contact our customer service team for detailed instructions.
– Refunds will be processed within 10 business days after receiving the returned products.
– Transportation and customs charges will not be refunded when the return is not due to a manufacturing defect or failure.
- Warranty
– We offer a limited two years warranty for our products, covering manufacturing defects and materials.
– The warranty does not cover damages caused by misuse, abuse, negligence, or unauthorized modifications.
- Intellectual Property
– All intellectual property rights related to the products are the exclusive property of RC Sailign Lab.
– Unauthorized reproduction, distribution, or modification of any copyrighted material is prohibited.
- Applicable Law
– These terms and conditions are governed by the laws of Spain, and any dispute arising in connection with these terms and conditions shall be subject to the exclusive jurisdiction of the courts of Madrid.
- Modifications
– We reserve the right to modify these terms and conditions at any time without prior notice. Modifications will be effective immediately upon posting on our website.
